Article 3: Characteristics of the Goods Sold
The product sold is the “Lourdes Top Secret” investigation game kit. This is a physical product (including a map and instructions among other items) allowing the Customer to carry out a self-guided scavenger hunt in the city of Lourdes. Access to the digital guidance tool (lourdes.top) is included with the purchase of the kit. The game is neither supervised nor timed.
Article 4: Price and Payment
The price of the “Lourdes Top Secret” kit is set at €15.00 including all taxes (TTC). Payment is due immediately upon ordering.
- Online Purchase: Payment is made by credit card via secure payment providers (e.g., Stripe, GetYourGuide).
- In-Store Purchase: Payment is made by [Cash / Credit Card / etc.] at 5 rue de la Grotte.
Article 5: Delivery and Pickup Terms
The “Lourdes Top Secret” kit is not shipped by post. Following an online purchase, the Customer must go to the pickup point located at 5 rue de la Grotte, 65100 Lourdes during opening hours [Specify hours or “indicated on the website”], bringing their order confirmation, in order to collect their physical kit and begin the activity.
Article 6: Right of Withdrawal and Refund
In accordance with current legislation on distance selling, the Customer has a period of 14 days to exercise their right of withdrawal after an online purchase, provided that the physical kit has not been collected or opened.
- Exception: Once the physical kit has been collected at the sales point and/or unsealed, the right of withdrawal no longer applies, as the goods cannot be returned for reasons related to protecting the gaming experience. To exercise this right before pickup, the Customer must send an e-mail to the contact address mentioned in Article 2.
Article 7: Liability and Safety
The Seller provides only the game equipment and access to the online platform. As the scavenger hunt takes place on public roads in complete autonomy:
- The Customer is solely responsible for their own safety and that of any minors accompanying them.
- The Customer agrees to comply with the Highway Code, pedestrian traffic rules, and municipal decrees of the city of Lourdes.
- The Seller declines all liability in the event of an accident, theft, loss of personal belongings, or material/physical damage occurring during the activity.
Article 8: Intellectual Property
All elements constituting the “Lourdes Top Secret” kit (texts, maps, riddles, graphics, name) and the associated website are the exclusive intellectual property of the Seller. Any unauthorized reproduction, resale, or exploitation of the kit is strictly prohibited and subject to legal action.
Article 9: Personal Data
Personal data collected during online ordering is necessary for processing the purchase. In accordance with the GDPR, the Customer has the right to access, rectify, and delete their data, applicable upon simple written request to the Seller.
Article 10: Applicable Law and Disputes
These TCS are subject to French law. In the event of a dispute, an amicable solution will be sought as a priority. Failing that, the French courts within the jurisdiction of the Seller’s headquarters shall have sole competence.
